TERMS AND CONDITIONS

For Tuition Clients:

On the purchase of 1 term of lessons is provided 10 lessons excluding term 4

If you or your child is unwell, or you or your child is unable to attend your lesson. No refund for the missed lesson will be issued.

If Josiah is unwell or need to miss a lesson for an unforeseen circumstance. The lesson will be caught up or a refund for that lesson ($30) will be issued.

If the invoice is not paid after the allocated time lessons will be paused and there will be no obligation to catch up on lessons even if the invoice is paid and lessons continue.

If the student cancels before the term is finished there is no obligation for a refund.

For production clients:

The product is not owned until compensation to Josiah Whillas has been paid E.g. backing track purchased / invoices payed etc.

Extra Charges for work like file retrieval, Stems bounced out, or file conversion may apply.

Copyright for the composition is split at 50% Josiah Whillas 50% Artist
Copyright for the lyrics is split at an arranged percentage that is fair to the lyrical content written. For example If Josiah has had no input into to lyrical content the no share of lyrical copyright will be given
Copyrighted works will be register to APRA ACMOS

Copyright terms may be changed with an agreement signed by both parties, e.g. a client who is a band, Josiah Whillas may take a smaller cut of the copyrighted work(s)

For Studio Clients

The product (recordings and any file associated) is not owned by the Client until the invoice is paid. This does not include copyright of written works but only applies to recorded material produced by Josiah Whillas Trading as Resurrection Rhythms. Which may include recorded performances by the client.

If studio time is missed there is no obligation for a refund.

If day rate has been paid a refund will be given except for the deposit paid which is nonrefundable.

If an invoice has not been paid there is no obligation to return / distribute copyrighted material.

For recorded tracks to be distributed in stems or the project files distributed the invoice needs to be paid prior to files being sent.

For Mix Clients

Mix clients must pay for the mix or a watermark and low quality file format may be used as security.

Once the invoice is paid in full then the water mark will be removed, and a higher quality file format will be used for distribution.

Mix Clients are entitled to 1 mix revision.

For Mastering Clients

 Invoice must be paid in full before work commences.  

Mastering Clients are entitled to 1 mastering revision.
